📸 Photo Usage and Licensing Agreement for Bands and Musicians
Effective Date: September 14, 2025
This Agreement sets forth the terms and conditions for the use of photographs produced by the Photographer, Baz Foye, trading as RokShotz. By using any of the Photographer's images, the client agrees to all terms contained herein.
1. Copyright and Ownership
The Photographer, Baz Foye (RokShotz), retains full intellectual property and all copyrights to all photographs, digital images, and original works created.
The Photographer reserves the right to use, reproduce, modify, and distribute the images for their own portfolio, marketing, and professional promotional purposes.
2. Grant of License
Upon delivery of the photographs, the Photographer grants the client a non-exclusive, non-transferable license to use the images under the following conditions:
2a. Personal Use: The client may use the photographs for personal, non-commercial purposes, including:
Sharing on personal social media accounts.
Displaying on personal websites or blogs.
Creating personal prints or albums.
2b. Band/Musician Commercial Use: The Band or Musician is granted a license to use the photographs for commercial purposes, including:
Marketing and advertising materials (online and print).
Promotional content on Band/Musician websites or social media.
Incorporation into documents or presentations.
Significant alteration of the photographs (e.g., applying heavy filters, cropping) is allowed.
3. Restrictions on Use
The client may not:
Sell, sublicense, or otherwise distribute the photographs to any third party.
Claim ownership of the photographs.
Use the photographs for any unlawful, defamatory, or offensive purpose.
4. Photo Credit / Attribution
Photo credit to the Photographer is NOT required for any usage.
5. Termination
The Photographer reserves the right to immediately terminate this license if the terms of this Agreement are violated. Upon termination, the client must immediately cease all use of the photographs and destroy any copies in their possession.
6. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Ontario, Canada, specifically referencing the Copyright Act.
